| 520 | 3 | |a La presente tesis es una investigación descriptiva y sigue la línea de investigación de la argumentación jurídica propuesta por la maestría en Política Jurisdiccional de la PUCP. Tiene como principal objetivo estudiar un aspecto poco conocido de la argumentación jurídica que realizan los registradores públicos de la Zona Registral N° IV Sede Iquitos de Superintendencia Nacional de los Registros Públicos cuando sus inscripciones son cuestionadas en la vía administrativa y judicial, tanto en materia civil y penal y en este último punto teniendo en cuenta las investigaciones que se hacen también solo a nivel del Ministerio Público. A lo largo de la tesis demostraremos la existencia de una argumentación jurídica registral diferente a la argumentación judicial y legislativa. Hemos establecido que esta argumentación tiene características propias en cuanto a la finalidad de la argumentación y que a su vez la argumentación post inscripción registral también lo tiene en relación a ésta última en la medida que es una argumentación que se realiza fuera del procedimiento y registral y que engloba solo un aspecto de toda la argumentación que realiza el registrador en la fase de la calificación de los títulos. Arribaremos a la conclusión que la argumentación post inscripción registral es una variante de la argumentación jurídica ya que se hace al margen del procedimiento y porque tiene como finalidad la defensa de inscripción y teniendo como trasfondo salvar de cualquier responsabilidad funcional del registrador This thesis is a descriptive investigation and follows the line of investigation of the legal argumentation proposed by the master's degree in Jurisdictional Policy of the PUCP. Its main objective is to study a little-known aspect of the legal argumentation carried out by the public registrars of the Registration Zone No. IV Iquitos Headquarters of the National Superintendence of Public Registries when their registrations are questioned in the administrative and judicial channels, both in civil matters. and criminal and in this last point taking into account the investigations that are also only carried out at the level of the Public Ministry. Throughout the thesis we will demonstrate the existence of a registration legal argumentation different from the judicial and legislative argumentation. We have established that this argumentation has its own characteristics in terms of the purpose of the argumentation and that, in turn, the post-registration argumentation also has it in relation to the latter, to the extent that it is an argumentation that is made outside the procedure and registry and which encompasses only one aspect of all the arguments made by the registrar in the qualification phase of the titles. We will come to the conclusion that the post-registration argumentation is a variant of the legal argumentation since it is done outside the procedure and because its purpose is the defense of registration and having as a background to save from any functional responsibility of the registrar. | |
