Resumen:The aim of this thesis is to explore the historical foundation and current norms of the delict of solicitation, especially when it is reserved to the competency of the Dicastery for the Doctrine of the Faith. An overview of the canonical history is first presented. There is a focus on the major papal documents promulgated in regard to the delict of solicitation since the Middle Ages. Secondly, the current law in force, canon 1385 in the Code of Canon Law, is presented and investigated so as to understand the essential elements of the delict. Finally, the preliminary investigation and penal procedure in adjudicating the reserved cases of solicitation is explored. The norms provided by the Holy See are included in the presentation of the process.
