| 520 | 3 | |a RESUMEN: El presente trabajo de investigación pretende abordar el tema del hacinamiento carcelario y para ello es imprescindible revisar el trabajo que desarrollan los órganos, organismos e instituciones del Estado, las organizaciones civiles y sociales que intervienen y trabajan en materia de seguridad, prevención del delito y de las conductas antisociales. No se necesita entrar en un profundo análisis para entender sobre la situación que actualmente atraviesa el sistema penitenciario en El Salvador, esto debido a que las políticas penitenciarias desde hace mucho tiempo no tienen los resultados esperados, el impacto de las políticas criminales centradas en la represión, en la imposición de penas prolongadas y en la debilidad o ausencia de las políticas de prevención del delito y de resocialización de los privados de libertad hace aún más complejo el problema, pues, todas estas acciones altamente represivas generan un alto índice de hacinamiento carcelario. En la primera parte de la presente investigación, se dará a conocer el grave problema de hacinamiento que se vive en las cárceles del país, planteando una serie de factores que han influenciado en dicha problemática, se analiza la situación de violencia que sufre nuestro país y se hace énfasis en que la readaptación y la reinserción son componentes básicos de una política criminal-penitenciaria, la cual, ha presentado diversos problemas e ineficiencias. En el capítulo tres de la segunda parte, se desarrolla la metodología de la investigación por medio de entrevistas a autoridades de los principales entes estatales que están directamente ligados con la problemática en estudio, las cuales son la Fiscalía General de la República, la Policía Nacional Civil de la ciudad de San Miguel, El Centro Penal de San Miguel y la Procuraduría para la Defensa de los Derechos Humanos de la ciudad de San Miguel, cada uno de los encargados da su postura en cuanto a la temática y se pudo corroborar con datos certeros que verdaderamente existe un alto índice de hacinamiento, específicamente en el Centro Penal y las Bartolinas de la Policía Nacional Civil en la ciudad de San Miguel. Y finalmente, en el capítulo cuatro de la segunda parte, se realizará un análisis sobre la problemática en la que se encuentra el sistema penitenciario y cómo influyen las políticas criminales en el creciente hacinamiento y se propondrá una serie de recomendaciones hacia los diferentes entes estatales involucrados en el problema en referencia para mejorar las condiciones en las que se rehabilitan los privados de libertad; ya que para encontrar una solución definitiva deben de existir medidas que interrelacionen a todos los agentes involucrados en el sector. Tomando en cuenta que todo se centra en el respeto a los derechos humanos y fundamentales de cada persona. | |
