| 520 | 3 | |a RESUMEN: La presente investigación de grado tiene como finalidad esencial analizar los posibles efectos jurídicos al marco normativo Salvadoreño con la puesta en marcha de las disposiciones emitidas por la Corte Interamericana de Derechos Humanos a través de la Opinión Consultiva número 24-17 sobre Igualdad de Género y no discriminación hacia parejas del mismo sexo; pues de acatar sus lineamientos se harían modificaciones sustanciales a la normativa jurídica actual en materia de derechos humanos. La comunidad Homosexual en El Salvador es uno de los nuevos grupos sociales que está generando controversia, esto debido a que exigen que el Estado les garantice sus derechos de igualdad y no discriminación para erradicar así conductas que ponen en peligro otros derechos esenciales. La actitud del Estado es pasiva en cuanto al reconocimiento de los derechos de este grupo social pues El Salvador no contiene material normativo específico sobre identidad de género y orientación sexual. Es por eso que es importante para este grupo de investigación determinar los avances que experimentaría El Salvador en materia de Derechos Humanos e identidad sexual. Por todo lo anterior es que este grupo de investigación ofrece a través de este documento dividido en 5 capítulos, una serie de datos tanto a nivel nacional como internacional. Dentro del capítulo I establecemos los parámetros de la investigación, dentro del cual se plantearon objetivos Dentro de capitulo IV encontramos los resultados obtenidos con la investigación de campo que se realizo a través de entrevistas a miembros de la comunidad LGBTI y también profesionales del Derecho, las cuales tiene como finalidad determinar si las hipótesis planteadas al inicio de la investigación son comprobables o no. Como punto final encontramos las conclusiones que básicamente está orientada al señalamiento de los puntos débiles encontrados en la legislación y la sociedad salvadoreña, pues como se vera en el desarrollo de la investigación los graves atropellos de derechos fundamentales de la comunidad de Lesbianas, Gay, Bisexuales, Transexuales e Intersexuales son producto del desinterés del Estado por garantizar plenamente el goce y ejercicio de esas garantías; asi mismo se señalan las recomendaciones a todos los sectores sociales, políticos y jurídicos del país para cambiar el clima de inseguridad jurídica que padece este sector. | |
| 520 | 3 | |a ABSTRACT: The essential purpose of this degree research is to analyze the possible legal effects on the Salvadoran regulatory framework with the implementation of the provisions issued by the Inter-American Court of Human Rights through Advisory Opinion number 24-17 on Gender Equality and not discrimination against same-sex couples; because if they abide by its guidelines, substantial modifications would be made to the current legal regulations on human rights. The Homosexual community in El Salvador is one of the new social groups that is generating controversy, this is because they demand that the State guarantee their rights to equality and non-discrimination in order to eradicate behaviors that endanger other essential rights. The State's attitude is passive in terms of recognizing the rights of this social group, since El Salvador does not contain specific normative material on gender identity and sexual orientation. That is why it is important for this research group to determine the advances that El Salvador would experience in terms of Human Rights and sexual identity. For all of the above, this research group offers, through this document divided into 5 chapters, a series of data both nationally and internationally. Within chapter I we establish the parameters of the investigation, within which objectives were set Within chapter IV we find the results obtained with the field research that was carried out through interviews with members of the LGBTI community and also legal professionals, the whose purpose is to determine if the hypotheses raised at the beginning of the investigation are verifiable or not. As a final point we find the conclusions that are basically oriented to pointing out the weak points found in the Salvadoran legislation and society, because as will be seen in the development of the investigation the serious violations of fundamental rights of the Lesbian, Gay, Bisexual community. , Transsexuals and Intersexuals are the product of the State's lack of interest in fully guaranteeing the enjoyment and exercise of these guarantees; Likewise, recommendations are made to all the social, political and legal sectors of the country to change the climate of legal insecurity that this sector suffers.. | |
