| 520 | 3 | |a RESUMEN: El presente trabajo de investigación establece el grado de independencia que poseen los niños, niñas y adolescentes frente a las facultades de los padres en cuanto al ejercicio de la capacidad progresiva así como el nivel de participación en el ejercicio de sus Derechos mediante figuras significativas como la capacidad jurídica procesal y la Legitimación Activa. OBJETIVOS. Determinar el cumplimiento o efectivo goce de los Derechos y garantías de los niños niñas y adolescentes en los respectivos Juzgados de la Ciudad de San Miguel que conocen sobre esta materia. METODOLOGÍA. La metodología empleada para el desarrollo de nuestro tema fue una investigación científica y analítica debido a que son procesos ordenados y complejos, sintéticos y analíticos que nos ayudaron a desglosar el tema de una manera más organizada y estructurada apoyándonos también en los métodos teóricos e hipotéticos. CONCLUSIONES. Se concluye que nuestro tema es de vital interés como rama especializada del derecho pues con la lepina se rompe con los paradigmas del niño como sujeto pasivo u objeto de protección del Estado y le crea una esfera jurídica donde se le reconoce como persona humana capaz de ejercer sus propios derechos de manera directa y ejecutar acciones cuando se le vulneren, así como ser parte en cualquier proceso donde sus intereses se vean afectados aunque hay sido iniciado por alguien más, teniendo Derecho a intervenir, opinar y ser oído, y ser prioridad en la tome decisión, como en la estimación de las posible repercusiones que genere este conflicto en el desarrollo evolutivo de las facultades de los niños, niñas y adolescentes. | |
| 520 | 3 | |a ABSTRACT: This research work establishes the degree of independence that boys, girls and adolescents have from the faculties of their parents regarding the exercise of Progressive Capacity as well as the level of participation in the exercise of their rights through significant figures such as the Procedural Legal Capacity and Active Legitimation. OBJECTIVES. Determine the compliance or effective enjoyment of the Rights and guarantees of children and adolescents in the respective Courts of the City of San Miguel that know about this matter. METHODOLOGY. The methodology used for the development of our topic was a scientific and analytical investigation because they are ordered and complex, synthetic and analytical processes that helped us to break down the topic in a more organized and structured way, also relying on theoretical and hypothetical methods. CONCLUSIONS. It is concluded that our topic is of vital interest as a specialized branch of law because with LEPINA it breaks with the paradigms of the child as a passive subject or object of State protection and creates a legal sphere where they are recognized as a human person capable of exercising their own rights directly and carry out actions when they are violated, as well as being part of any process where their interests are affected even though it has been initiated by someone else, having the right to intervene, give their opinion and be heard, and be a priority in the make a decision, as in the estimation of the possible repercussions that this conflict generates in the evolutionary development of the faculties of children and adolescents. | |
