| 520 | 3 | |a RESUMEN: La presente investigación tratará sobre el análisis de la legislación Salvadoreña en la figura de la sucesión por causa de muerte, ello en virtud de la confusión en relación a su naturaleza jurídica que, radica en si es un título, un modo o una relación jurídica sui generi, por ello se analizará el sistema normativo Salvadoreño, para identificar por medio del análisis las diferentes características y elementos que la integran, de igual forma las diferentes teorías que sustentan las diferentes posturas. Por consiguiente, se hará un estudio comparativo de las legislaciones en el área civil con énfasis en la chilena que es base para la elaboración de muchas legislaciones en centro América, así como Guatemala, Nicaragua, Honduras, de las cuales se hará un análisis comparativo que permita señalar sus diferencias y similitudes en el tema de estudio, con la Legislación Salvadoreña. La metodología a utilizar principalmente estará basada en el método científico herramienta indispensable para cualquier investigación, consiste en la lógica general empleada a la investigación, el cual se ampara en los métodos del análisis, síntesis, y comparativo, con ellos se podrá recabar toda la información necesaria e indispensable para el tema de investigación los cuales se complementan entre sí. La conclusión en relación al objeto de estudio de la investigación tenderá a la disolución de los problemas planteados, de igual forma a la comprobación o refutación de las hipótesis planteadas para la facilitación y compresión de la sucesión por causa de muerte en la legislación salvadoreña.ABSTRACT: This research will deal with the analysis of Salvadoran legislation in the figure of succession due to death, this by virtue of the confusion in relation to its legal nature that lies in whether it is a title, a mode or a sui generi legal relationship, therefore the Salvadoran normative system will be analyzed, to identify through analysis the different characteristics and elements that make it up, in the same way the different theories that support the different positions. Therefore, a comparative study of the legislations in the civil area will be made with emphasis on the Chilean one that is the basis for the elaboration of many legislations in Central America, as well as Guatemala, Nicaragua, Honduras, of which a comparative analysis will be made to indicate their differences and similarities in the subject of study, with Salvadoran Legislation. The methodology to be used mainly will be based on the scientific method indispensable tool for any research, consists of the general logic used to the research, which is based on the methods of analysis, synthesis, and comparative, with them you can collect all the necessary and indispensable information for the research topic which complement each other. The conclusion in relation to the object of study of the investigation will tend to the dissolution of the problems raised, in the same way to the verification or refutation of the hypotheses raised for the facilitation and understanding of the succession due to death in Salvadoran legislation. | |
