| Resumen: | RESUMEN: El estudio de esta problemática se realiza desde la óptica de los derechos humanos emergentes, que pretenden dar respuesta a la necesidad de reconocer nuevos derechos o proteger los derechos ya reconocidos pero que por por diversas situaciones se encuentran sumergidos, por lo que se convierten en tema de interés en lo que respecta a la protección de la población de niñez migrante que se encuentra temporal o permanentemente dentro del territorio salvadoreño. Dentro del marco doctrinal, se desarrolla como surgen los derechos humanos emergentes y cual es su contenido y características, de manera que se tenga una visión clara de la influencia que estos pueden tener en la normativa nacional, se detallan las causas que motivan la migración de este colectivo, las múltiples circunstancias de exclusión y riesgos al as que deben enfrentarse los NNA migrantes dentro de la ruta migratoria y que los colocan en situación de desventaja frente a los nacionales, así como las características propias de este grupo y los perfiles de vulnerabilidad que permiten la identificación de las particularidades y condiciones en que se sitúan, del mismo modo, se desarrolla lo relativo al derecho a la igualdad de derechos plena y efectiva, tutelado en la Declaración Universal de Derechos Humanos Emergentes. En torno al tema de investigación, se realizaron entrevistas a representantes de las diversas instituciones que intervienen en la tutela de los derechos de los NNA migrantes que residen en nuestro país, lo que nos permite determinar en qué medida han contribuido los derechos humanos emergentes para mejorar las condiciones de igualdad para la niñez migrante en El Salvador, cuáles son las situaciones de riesgo o exclusión que viven en la travesía y en el lugar de destino, y definir qué tanto se protege a este colectivo vulnerable en nuestro país a través de los distintos instrumentos normativos aplicables en el contexto nacional y grupo poblacional en estudio. ABSTRACT: The study of this issue is carried out from the perspective of emerging human rights, which aim to respond to the need to recognize new rights or protect rights already recognized but which are submerged due to various situations, which is why they become a topic of interest with regard to the protection of the migrant child population that is temporarily or permanently within Salvadoran territory. Within the doctrinal framework, it develops how emerging human rights arise and what their content and characteristics are, so that there is a clear vision of the influence that these can have on national regulations, the causes that motivate the migration of this group are detailed, the multiple circumstances of exclusion and risks that migrant children and adolescents must face within the migratory route and that place them at a disadvantage compared to nationals, as well as the characteristics of this group and the vulnerability profiles that allow the identification of the particularities and conditions in which they are located, in the same way, the relative right to full and effective equality of rights is developed, protected in the Universal Declaration of Emerging Human Rights. Regarding the research topic, interviews were conducted with representatives of the various institutions involved in safeguarding the rights of migrant children and adolescents residing in our country. This allows us to determine to what extent emerging human rights have contributed to improving the conditions of equality for migrant children in El Salvador, what are the situations of risk or exclusion that they experience during the journey and at the destination, and to define how much this vulnerable group is protected in our country through the various regulatory instruments applicable in the national context and population group under study. |
